Terms and Conditions

1. Acceptance of Terms

By installing Zen Feed from the Shopify App Store, accessing our website at https://zenfeed.zensharks.com, or using any part of our service, you ("Merchant" or "you") agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy.

If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not install or use Zen Feed.

These Terms constitute a legally binding agreement between you and Zensharks, the operator of Zen Feed.

2. Service Description

Zen Feed is a Shopify application that enables merchants to:

• Connect their Instagram Business or Creator account via the Instagram Graph API
• Automatically sync Instagram posts, Reels, and carousels to their Shopify store
• Display Instagram content on their storefront using customizable feed widgets
• Track feed performance through analytics (views, clicks, engagement)
• Manage multiple feed layouts and display configurations

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where possible.

3. Eligibility

To use Zen Feed, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Have a valid Shopify store in good standing
• Have a valid Instagram Business or Creator account (for Instagram integration features)
• Have the legal authority to enter into these Terms on your own behalf or on behalf of your organization
• Not be prohibited from receiving services under applicable laws

4. Account & Registration

Your Zen Feed account is created automatically when you install the app via Shopify. You are responsible for:

• Maintaining the security of your Shopify and Instagram account credentials
• All activity that occurs through your connected accounts
• Promptly notifying us at zensharksofficial@gmail.com if you suspect unauthorized access
• Keeping your account information accurate and up to date

You may not transfer your Zen Feed subscription or account to another party without our prior written consent.

5. Acceptable Use

You agree not to use Zen Feed to:

• Violate any applicable laws, regulations, or third-party rights
• Display content that is illegal, defamatory, harassing, obscene, or infringes intellectual property rights
• Scrape, crawl, or systematically extract data from our service beyond normal app usage
• Attempt to reverse engineer, decompile, or otherwise access our source code
• Interfere with or disrupt the integrity or performance of the service or its infrastructure
• Use the service to store or transmit malicious code, malware, or harmful data
• Resell, sublicense, or make available the service to third parties without authorization
• Circumvent any usage limits, subscription tiers, or access controls
• Use automated scripts to interact with the service in ways that exceed normal usage patterns

We reserve the right to suspend or terminate accounts that violate these acceptable use policies, with or without prior notice depending on the severity of the violation.

6. Instagram Integration

Zen Feed's Instagram integration is subject to Meta's Platform Terms and Instagram's Terms of Use. By connecting your Instagram account, you additionally agree that:

• You are the rightful owner of or have full authorization to use and display the Instagram content shown in your feeds
• Your use of the Instagram integration complies with Instagram's Community Guidelines and Terms of Use
• Zen Feed accesses your Instagram account in read-only mode and does not post, modify, or delete any content on your behalf
• Instagram access tokens may expire or be revoked by Instagram at any time, which may temporarily interrupt syncing
• We are not responsible for changes to the Instagram Graph API that may affect service functionality
• You must have an Instagram Business or Creator account (not a personal account) to use the integration

You can disconnect your Instagram account at any time from within the Zen Feed dashboard or directly through Instagram's connected apps settings.

7. Shopify Platform

Zen Feed is built on the Shopify platform and is subject to Shopify's API Terms of Service and Shopify Partner Program Agreement. You acknowledge that:

• Your Shopify store must remain in good standing for Zen Feed to function correctly
• Shopify may update its platform in ways that temporarily affect Zen Feed functionality
• Zen Feed billing is processed through Shopify's billing system and subject to Shopify's billing policies
• Uninstalling the app from your Shopify store will terminate your access to Zen Feed

8. Subscription & Billing

8.1 Plans

Zen Feed offers a free plan and paid subscription plans. Plan features, limits, and pricing are listed at https://zenfeed.zensharks.com/#pricing and are subject to change with 30 days' notice.

8.2 Billing

Paid subscriptions are billed through Shopify's billing system. Charges appear on your Shopify invoice. By subscribing to a paid plan, you authorize Shopify to charge your payment method on a recurring basis at the frequency specified in your plan.

8.3 Free Trial

Where a free trial is offered, it begins on the date you install the app. At the end of the trial period, your account will automatically convert to the free plan unless you select a paid subscription.

8.4 Cancellation & Refunds

You may cancel your paid subscription at any time by uninstalling the app or downgrading your plan within the Zen Feed dashboard. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods unless required by applicable law.

8.5 Price Changes

We reserve the right to modify subscription pricing. We will provide at least 30 days' notice before any price increase takes effect. Continued use of the service after the notice period constitutes acceptance of the new pricing.

9. Intellectual Property

9.1 Our Property

Zen Feed, including its source code, design, algorithms, user interface, and branding, is owned by Zensharks and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in Zen Feed.

9.2 Your Content

You retain full ownership of your Instagram content and Shopify store data. By using Zen Feed, you grant us a limited, non-exclusive, royalty-free license to access, store, and display your Instagram content solely for the purpose of providing the service to you.

9.3 Feedback

If you provide us with feedback, suggestions, or ideas about the service, you grant us the right to use that feedback without restriction or compensation to you.

10. Data & Privacy

Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Zen Feed, you consent to the data practices described in our Privacy Policy.

In the context of data protection laws (including GDPR), Zensharks acts as a data processor on behalf of merchants (who are the data controllers) with respect to any personal data of their end-customers that flows through Zen Feed's analytics features.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The service will be uninterrupted, error-free, or completely secure
• Instagram content will sync without delay or interruption
• The service will meet your specific business requirements
• Any errors or defects will be corrected within a specific timeframe
• The service will be compatible with all Shopify themes or third-party apps

We are not responsible for any disruptions to the service caused by changes to the Instagram Graph API, Shopify platform updates, or third-party infrastructure outages (including our cloud hosting provider).

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZENSHARKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF ZEN FEED, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Zensharks and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of or access to Zen Feed
• Your violation of these Terms
• Your violation of any third-party rights, including Instagram's Terms of Use or any intellectual property rights
• Any content you display through Zen Feed that infringes a third party's rights
• Your violation of any applicable laws or regulations

14. Termination

14.1 By You

You may terminate your use of Zen Feed at any time by uninstalling the app from your Shopify store. Your data will be handled according to our Privacy Policy.

14.2 By Us

We may suspend or terminate your access to Zen Feed immediately and without notice if you:

• Materially breach these Terms and fail to cure the breach within 7 days of notification
• Violate our Acceptable Use Policy (Section 5) in a way that poses a risk to the service or other users
• Fail to pay applicable fees
• Are required by law or regulatory authority to do so

14.3 Effect of Termination

Upon termination, your right to use the service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, liability limitations, and indemnification) will continue to apply.

15. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email (if you have provided one) or by displaying a prominent notice within the app, and we will update the "Last updated" date at the top of this page.

Your continued use of Zen Feed after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service and uninstall the app.

16. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the service shall be resolved through good-faith negotiation first. If the dispute cannot be resolved amicably, it shall be submitted to binding arbitration or the competent courts of the jurisdiction in which Zensharks operates.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zensharks regarding Zen Feed and supersede all prior agreements and understandings.
